Following up my earlier entry, there has been a response from the working group.

To short circuit it, this was my editorial error. It has been removed in the current editors draft, and will be updated in the public draft shortly.

The topic has also stimulated some discussion over this section of the spec and there are now people pushing for a stronger stance against the use of text/html for XHTML 1.1.

This is, in my opinion, a good thing. Most of the benefits of XHTML are lost when served as text/html, so the less we see of it the better.
